PollZapper is an AI-powered, enterprise-grade polling platform designed for professional polling companies, market research firms, and scientific research organizations. Our platform provides:

Questionnaire Designer - Visual flowchart-style survey creation tools
Field Operations Management - Canvasser dispatch and quality control

User Accounts

Registration

To use our platform, you must:

Be at least 18 years old
Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access

Account Types

Pollster Tenants: Subscription-based accounts for polling companies
Marketplace Tenants: Workload tracking accounts for service providers
Team Members: Users invited to collaborate on polling projects

Acceptable Use Policy

You agree NOT to:

Violate any laws or regulations
Infringe on intellectual property rights
Transmit malicious code or viruses
Attempt to gain unauthorized access to our systems
Use the platform for fraudulent purposes
Harass or harm other users
Collect data from respondents without proper consent

Professional Polling Standards

Users conducting polling research must:

Comply with all applicable polling regulations and standards
Obtain proper consent from survey respondents
Protect respondent privacy and confidentiality
Follow ethical research practices
Accurately represent polling methodologies and results

Intellectual Property

Our Property

PollZapper and its original content, features, and functionality are owned by PollZapper, Inc. This includes:

AtlasSampler™ trademark and methodology
Platform source code and algorithms
AI copilot systems
Design elements and branding

Your Content

You retain ownership of:

Questionnaire content you create
Survey response data you collect
Project materials and reports
Your organization's branding and materials

By using our platform, you grant us a limited license to:

Host and process your content
Display your content within the platform
Perform technical operations necessary to provide the service

Data and Privacy

Multi-Tenant Data Isolation

Each tenant receives a dedicated, isolated database
Your polling data is never shared with other tenants
Complete separation of tenant configurations and features
Enterprise clients may deploy on their own infrastructure

Data Ownership

You own all survey response data collected through your projects
We do not claim ownership of your polling research or results
You are responsible for complying with data protection regulations
Data retention follows your organization's policies

Payment Terms

Subscription Fees

Pollster tenants pay monthly or annual subscription fees
Fees are based on selected plan and features
Payment is processed securely through Stripe
Enterprise clients may arrange manual payment terms

Refund Policy

Subscription fees are non-refundable
You may cancel your subscription at any time
Cancellation takes effect at the end of the current billing period

Service Availability

Uptime Commitment

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted service. We are not liable for:

Scheduled maintenance downtime
Service interruptions beyond our control
Third-party service failures

Support

Standard support included with all subscriptions
Priority support available for enterprise clients
Support hours: Monday-Friday, 9 AM - 5 PM ET

Termination

By You

You may terminate your account at any time by:

Canceling your subscription through account settings
Contacting our support team
Requesting account deletion

By Us

We may suspend or terminate your account if you:

Violate these Terms of Service
Fail to pay subscription fees
Engage in fraudulent activity
Pose a security risk to our platform

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for indirect, incidental, or consequential damages
Our total liability is limited to the fees you paid in the past 12 months
We do not guarantee the accuracy of polling results
You are responsible for your use of the platform and polling data

Indemnification

You agree to indemnify and hold harmless PollZapper, Inc. from any claims arising from:

Your violation of these Terms
Your use of the platform
Your polling activities and research
Infringement of third-party rights

Dispute Resolution

Governing Law

These Terms are governed by the laws of the United States and the State of Delaware.

Arbitration

Most disputes can be resolved through our support team. For formal disputes:

Parties agree to binding arbitration
Arbitration conducted in Delaware
Each party bears its own costs
Class action lawsuits are waived

Changes to Terms

We may modify these Terms at any time. We will:

Post updated Terms with a new Effective Date
Notify you of material changes via email
Give you the opportunity to terminate if you disagree

Continued use after changes constitutes acceptance of the new Terms.
